Definitions P & W / We means Phillips and Wood “The Condition” means the terms and conditions set out below and unless where agreed between the parties to the contrary in writing shall apply to all contracts for the supply of goods by P&W. “The Contract” means the contract between P & W and the customer of which these conditions form part. “The Customer / You” means the person, firm, or company with whom the contract is made. “The Goods” means the goods displayed for sale on the Website and/or subsequently supplied to the customer by P & W. “The Order” means the on line or written (including e-mail) order made by the customer. 2. Prices and payment When confirmation of your order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable. a. All prices are those in force at the date of invoice. b. VAT. Currently, P&W is not VAT registered. c. P & W shall be entitled to vary its price list at any time and from time to time without prior notice to the customer. d. If any taxes or duties are applicable they will be charged at the rate ruling at the date of invoice. Any taxes or duties for deliveries outside of main land UK shall be the responsibility of the customer. e. Payment for all goods supplied by P & W shall be in UK Sterling. f. Payment is generally to be made by credit or debit card through the P & W secure on line payment system. Any credit card details you enter are transmitted over a secure (SSL) link and stored using 128-bit encryption. 3. General representation Description, P & W makes every effort to ensure the accuracy of descriptions and images on this web site. However, as the items offered are natural or hand made products, there may be some minor variations in the goods received. a. Our photographs are intended to be as accurate a representation as possible, but are subject to photographic limitations and the differences between computer screens and settings. b. All dimensions where given are approximate. c. Availability of the items displayed on this web site is not guaranteed. d. Unless marked as a “one-off” item, P&W cannot guarantee to supply you with an exact piece. The examples shown in the photographs unless marked are typical examples of the items concerned. However, each piece is individual and will vary in size, shape and colour. e. VAT is currently not applicable to our prices. Overseas purchasers are responsible for any local customs fees, duties and taxes required. f. Risk in the goods passes to the customer on delivery of the goods to the address stated in the customers order. 4. Delivery P & W will endeavour to dispatch all orders within 48 hours of receiving payment authorisation. However, there may be occasions when we are attending shows or away from the office on business. Nonetheless P & W would always expect you to receive the goods ordered within 14 days of order confirmation, unless advised otherwise. All orders will be sent by first class (recorded or registered) post or courier. 5. Non Delivery If you have not received the goods with 14 days of the date of order confirmation, you are requested to advise P & W immediately by e-mail. Quoting purchasers name, date of order and method of payment. 6. Returned and Damaged Goods 6.i Distance selling regulations / unwanted items. a. Under the consumer protection (distance selling) regulations, the customer has the legal right to cancel the order within 7 days of the date goods are received. P & W will refund the costs of the goods being returned within 30 days of the goods being returned in satisfactory condition. In addition, customers from the European Union are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm b. The customer must advise P & W before returning any goods in order to obtain a “returns reference number” which is to be marked on the returned package. Returns will not be accepted unless this proceedure is followed. c. Goods must be returned in original condition and packaging and by a trackable delivery method. P & W must be advised by e-mail of all tracking or consignment numbers immediately they are known. P & W will not be responsible for any goods lost of damaged during return. d. The customer is responsible for the cost of returning any unwanted items to us. 6ii. Damaged goods. P & W will take utmost care to securely pack all goods. If however, they are found to be damaged upon receipt you are requested to e-mail P & W immediately. P & W will then contact you to discuss the options available to resolve the matter. 6iii Earrings and Studs. For hygeine reasons, earrings and studs are not returnable unless faulty. 7. Security WE have taken great care to ensure this website is secure as possible. Any credit card details you enter are transmitted over a secure (SSL) link and stored using 128-bit encryption. 8. Liability Except as may be otherwise required by law, P & W will accept no liability to the customer or its customers under any so called “product liability laws” in force at any time in any part of the world nor shall P & W be liable to the customer or any one else for any incidental or consequential damage or loss of business or property. 9. Law and Jurisdiction The contract shall be deemed to be made in England. All contracts made between P & W and the customer shall be governed by the laws of England and any dispute arising therein shall be subject to the sole jurisdiction of the English courts. 10. Acceptable Use Policy Any material down loaded or otherwise obtained through the use of this website is done at your own discretion and risk and that you will be solely responsible for any damage to your own computer system or lost of data that results from the download of any such material. This website is copyright Phillips and Wood. All rights reserved or the copyright of our licensors. You may download to a local hard disc and print extracts from this website for your personal use. You may also copy downloaded extracts to others provided you do not do so for profit. However, reproduction of part or all of the contents of this website is prohibited unless for personal use. None of the content of the website may be copied or otherwise incorporated into or stored in any other website, electronic retrieval system, publication or other work in any form ( whether hard copy, electronic or other). For the avoidance of doubt, framing of this site or any part of it is not permitted without our express permission 11. Privacy Policy We conform to the data protection act. The customers’ details are processed only for the purpose of fulfilling the order and will not be shared with any third other than our payment processor. The customer may ask for their details to be added to our e-news letter list, but this will not be undertaken unless requested. Each e-news letter P & W sends will have details as to how you can unsubscribe to future marketing e-mails and newsletters. You are untitled to ask for a copy of the personal information we hold on you (for which we may charge a small fee) and to correct any inaccuracies. 12. Acceptance On placing an order with P & W, the customer is deemed to have read, understood and accepted these terms and conditions. Statutory Rights These terms and conditions do not affect your statutory rights as a consumer or customer
